arccultural.cat is an Internet domain and trademark registered by ARC Gestió Cultural CIF B66069014, registered in Reg. Mercantil Barcelona, ​​T. 43821, Foli 103, Sheet B-439.265, located at carrer Sant Joan, 39, 3er, 08800, Vilanova i la Geltrú (from now on, ARC).
The use by the user of the services contained on the arccultural.cat website implies the express acceptance of the following general conditions:
General contract conditions between ARC and the user:
1. The user declares that he is of legal age (over 18) and has the necessary legal capacity to contract the services offered on the ARC website, also declaring that he accepts the binding of this agreement and understands and accepts in all the conditions stated here to use this website and contract the services offered.
The user undertakes to use the services and content on our website in accordance with the Law and the general and particular terms and conditions of the services offered by ARC at all times, and may not use for:
(A) Introduce into the network data programs likely to cause damage to the IT systems of ARC, its suppliers or third party users of the internal network or of this Website.
(B) Carry out illegal activities, contrary to good faith, customs and morals of public order.
(C) Carry out activities that constitute an infringement of the regulation on intellectual and industrial property or any other rule of the applicable legal system.
(D) Reproduce, duplicate, sell or exploit for commercial purposes any content of the Website.
(E) Disseminate content of a racist, xenophobic, pornographic nature, advocating terrorism and/or that violates human rights.
2. The user, in order to be able to contract the different services offered by ARC, must register as a client, for the purposes of the declaration, that all the information provided at the time of registration is true, complete and accurate and that in accordance with organic law 3/2018 on Protection of Personal Data and Guarantee of Digital Rights, and by REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT and OF THE COUNCIL of April 27 and on the protection of personal data (LOPD), the person who registers expressly authorizes ARC to proceed to include in an automated file the personal data appearing in the fields of the form to be necessary for the adequate provision of its services such as:
(A) Book tourist services and develop services related to the marketing of said services.
(B) Verify credit cards and other types of payment cards.
(C) Perform statistical analyses.
(D) Comply with ARC's accounting, billing and auditing requirements.
It is indicated that the person responsible for the file is the mercantile company ARC Gestió Cultural SL (c/ Sant Joan, 39, 3er 08800 Vilanova i la Geltrú, ​​Tel.: 669 28 82 20, email: info@arccultural.cat), for the purposes of exercising the rights of access, rectification, cancellation and opposition provided for in the Law. The communication of this data to third parties is also expressly authorized when it is necessary for the adequate provision of the services that are contracted, respecting at all times the legislation in force.
The user gives his express consent to receive electronic communications with advertising and commercial news from ARC and the products or services it markets or promotes. ARC makes available to users the means of contact referred to in the previous paragraph for them to revoke their consent.
In the case of purchasing the reservation via the web, the entire amount must be paid at the time of the reservation. The entire reservation made through other channels must be paid in cash on the day of the activity.
In case of cancellation of the reservation, up to 24 hours before the day of the activity, the total amount paid will be returned.
No show on day of service: No refund.
In the event that the activity is canceled due to bad weather, as long as the activity has not started, ARC will postpone the activity for another day or refund you.
Confirm the weather conditions 24 hours before starting the activity.
The prices indicated on the screen include VAT and any other applicable tax and will be valid at all times, except for typographical errors.
3. All content, brands, logos, drawings, etc. that appear on the arccultural.cat website, are protected by intellectual and industrial property rights that are expressly reserved by ARC or, where appropriate, by the people or companies listed as authors or holders of the rights. Violation of the above rights will be prosecuted in accordance with current legislation. Therefore, the reproduction, exploitation, alteration, distribution or public communication by any title or means of all the contents of the ARC website for uses other than legitimate information or contracting by users of the services offered is prohibited. In any case, the prior written consent of ARC will be required.
4. The user accepts that the legislation applicable to the operation of this service is Spanish. They will be competent to know the differences that arise from the interpretation or application of these clauses by the judges and tribunals of Barcelona. In case of litigation with users domiciled in a member state of the European Union other than Spain, the parties agree, waiving the jurisdiction that may apply to them, that the international judicial jurisdiction to hear the litigation arising from the application of these conditions general for the recruitment corresponds to the judges and courts of the city of Barcelona.
ARC reserves the right to make the changes it deems appropriate in the established terms and conditions. Modifications will be prominently featured on the ARC website.

6. ARC makes all the necessary efforts within its reach to offer the information contained on the website truthfully and without typographical errors. In the event that at any time an error of this type occurs, beyond ARC's control at all times, it will be corrected immediately. If there is a typographical error in any of the prices displayed and a customer has made a purchase decision based on this error, ARC will notify the customer and the latter will have the right to cancel their purchase at no cost to them.
7. The processing of a reservation by the ARC client implies knowledge and express acceptance of these general conditions.
8. ARC informs its users that regardless of the personal data it obtains from users who contract its services, ARC obtains and stores the following information:
(A) Number of visitors.
(B) Domain name of the provider that gives them access to the network.
(C) Date and time of access to the Website.
(D) Internet address from which the link that directs ​​the user to our website originates.
9. If any clause included in these general conditions is declared, in whole or in part, null or ineffective, such nullity or ineffectiveness will affect only this provision or the part of it that is null or ineffective, subsisting the general conditions in all the rest, having said provision, or the part of it that was affected, for not being put.
